Supplemental Injury Leave Policy


Purpose

To provide paid leave to regular, full-time employees to make up the difference between Workers' Compensation benefits (Temporary Income Benefits or TIBs) and net pay.

Summary

Eligibility:
  • All Regular, Full-time Employees Injured on the Job

    Hours/Days Per Year:
  • Twelve Weeks Per Injury

    Use:
  • To Supplement Employee Income While Off the Job for a Work-Related Injury

    Supplemental Injury Leave Benefits May Be Denied or Discontinued For Any of the Following Reasons:
  • Failure to Report Injury/Illness As Required
  • Failure to Report to a Physician or an Independent Medical Review Selected By the City ( Includes Initial Treating Physician/referrals Made By Treating Physician)
  • City Selected Physicians
  • PrimaCare
  • Medical Center of Lewisville Occupational Health Center
  • Lewisville Medical Center Hospital (After Hours)
  • Failure to Give Written Consent for the Release of All Pertinent Medical Information to the City of Lewisville or Later Withdraw Consent
  • Employee Does Not Follow the Recommended Medical Care, Physical Therapy, Rehabilitation and Modified Duty Program
  • Employee Is Found to Be Working at Any Job, Including Self-employment
  • Employee Resigns or Is Terminated for Any Reason
  • Employee Retires or Dies
  • Employee Falsifies or Misrepresents His Disability, Illness, Injury or Medical Condition
  • Employee Refuses to Return to Regular Duty on the Day Specified by the Treating Physician
  • Employee Is No Longer Eligible for Workers' Compensation Benefits

    Supplemental Injury Leave may be received for the first 12 consecutive weeks from the date of injury including the first seven days. In no case will the employee be provided more than 12 weeks of Supplemental Injury Leave for the same injury. An employee who is unable to return to work within 12 weeks may choose to supplement his Workers' Compensation benefits with other forms of leave. However, in no case may the use of paid leave increase the employee's total income beyond regular net pay.

    Regular Full-time employees who are injured on-the-job and are eligible to receive Workers' Compensation benefits (Temporary Income Benefits) may be eligible to receive Supplemental Injury Leave. Supplemental Injury Leave makes up the difference between Workers' Compensation weekly benefits and regular net pay. Under the Texas Workers' Compensation Act, Temporary Income Benefits extend for 104 weeks from the date of injury or until the employee reaches Maximum Medical Improvement (MMI).

    Follow-up health care appointments or continuing physical therapy are not covered by Supplemental Injury Leave once the employee returns to work regardless of whether the employee has been granted a full-duty release.
