Texas’ New Television Recycling Law


Texas Governor Rick Perry signed Senate Bill 329 into law on Friday, June 17, 2011, paving the way for consumers to recycle old televisions at no cost and making Texas one of 20 states with both computer and television recycling laws. SB 329 requires manufacturers selling televisions in Texas to provide free, convenient recycling programs for individual consumers in the state, and is similar to the computer takeback law passed in 2007. The bill was sponsored by Senator Kirk Watson and Representative Warren Chisum and was supported by The Consumer Electronics Association, which represents more than 2,000 electronics companies.

Producer responsibility laws are significant in that they require manufacturers to take responsibility for the products they manufacture throughout the products’ life cycles. The result is a reduced burden on local governments to manage disposal of products that can be difficult to dispose of properly at the end of their useful lives. Televisions, for example, can contain several pounds of lead and mercury bulbs, and improper disposal can contaminate soil and water sources.

Although the law becomes effective September 1, 2011, the Texas Commission on Environmental Quality will be designing the rules to implement and enforce the new law over the next 10 months.
